About the Fire Marshal's Division:
The Town of Babylon's Fire Marshal's Office protects life and property from fires, explosion, and man-made and natural hazards through aggressive investigation of fire and explosion incidents, quality fire protection inspection services, enforcement of the State Fire Prevention laws, data collection and analysis, and public safety education. The Fire Marshal's Office works with 11 fire departments and one Ambulance Corp, encompassing the 58 square miles of the Town of Babylon. Fire Marshals are NYS peace officers and can issue summons and make arrests.
The Fire Marshal's Office is responsible for:
- Investigation involving hazardous materials, homeland security incidents, plan reviews, and public education
- Issuing violation and criminal appearance tickets to ensure compliance with the town's codes
- Restricting occupancy of a building or use of equipment due to violation of the law and adverse health and safety conditions
- The enforcement of the New York State Fire and Building codes, the Code of the Town of Babylon, and the NFPA Code
The Town of Babylon Fire Marshal's Office should not be confused with the various Fire Departments operating in the Town of Babylon.

- The enforcement of the NYS Fire and Building Codes, the Town Code, and the NFPA Code, as well as issuing violation and criminal appearance tickets for noncompliance with those codes
- Restricting occupancy of a building or use of equipment due to violation of the law and adverse health and safety conditions
- Investigation involving hazardous materials, homeland security incidents, inspections, plan reviews and education
- Where is the Fire Marshal's Office located and what are their hours?

The Fire Marshal's Office is located at 281 Phelps Lane, North Babylon, NY 11703 at the Town Hall Annex. The office hours are Monday through Friday, 8:00 am to 4:30 pm. Fire Marshals are on call for response 24 hours a day, 7 days a week.

If you are experiencing an actual emergency, whether fire, fire alarm, carbon monoxide or other hazardous condition related, immediately contact Suffolk County Police by dialing 9-1-1. For Fire and Rescue Dispatch in the Town of Babylon, dial (631) 226-1212. In East Farmingdale, call (631) 249-0474 for fire and rescue dispatch.
- Do I need carbon monoxide detectors in my home or business?

Yes, several State, County and local laws do require carbon monoxide detectors in homes and businesses, including Amanda's Law, which specifically requires that carbon monoxide detectors be installed in homes. This law can be found online on the NY State Department website.
- Do I need smoke detectors in my home or business?

Yes, all residential properties require smoke detectors in each sleeping area as well as adjacent to sleeping areas. Depending on when a house was built, some smoke detectors will either need to be battery powered or required to be hard-wired and interconnected. The Fire Marshal's Office can provide more specific information.
- Is it legal to have a fire pit in a backyard?

No, it is illegal to have an open fire or flame of any type on a property. The only exception is an outdoor grill, a similar cooking appliance or an appliance that cooks over a wood flame. You can only use the amount of wood necessary for cooking and the fire must be immediately extinguished upon completion. All wood must be seasoned firewood only. No fresh cut branches or debris. Residents are urged to never leave an open flame or outdoor cooking appliance unattended.
- Can I barbecue if I live in an apartment?

You can barbecue if you live on the 1st floor of an apartment complex, but the barbecue grill/appliance must be used at least 15 feet away from the apartment building. You may not barbecue on an apartment patio or deck if you live on the 2nd floor or higher.
- Do fire extinguisher's need to be inspected?

Yes, fire extinguishers must be inspected on an annual basis by a licensed contractor (not by the Fire Marshal's Office). The contractor must be licensed by Suffolk County to perform this work.
- How do I dispose of an old fire extinguisher?

Old fire extinguisher's cannot be thrown out with regular trash items or recycled items but can be brought to the Fire Marshal's Office for disposal. You may also contact the Fire Marshal's office at (631) 957-2153 to pick up any old fire extinguishers.
- Are there Emergency Shelters available to residents in an event of a storm or natural disaster?

Yes, there are emergency shelters throughout the Town but they are not always open during every storm. If there is a severe storm in the area, residents are urged to listen to the local radio stations for shelter location information. The Department of Emergency Preparedness has more information about what to do during natural disasters or storms, including where to locate designated emergency shelters.
- Can fuel be delivered to a boat, house or dock?

No, all fueling must be done at a marine gas and fuel station and cannot be done on private property.

- I had a Fire at my property, how do I obtain a copy of the Fire Report?

If the Fire Marshal’s Office responded to an incident, you can get a copy of the Fire Report by first completing a Freedom of Information Law form at the Town Clerk’s Office at Babylon Town Hall. . Additionally, you can get a copy of a Fire Report from the Local Fire Department that responded.

- What permits does the Fire Marshal's Office issue?

The Fire Marshal's Office is responsible for the inspection and issuance of Use/Operational Permits and Installation/Construction :
- Use/Operational Permit Application (Fire Prevention Form 1)
- Installation/Construction Permit Application (Fire Prevention Form 2)
- Public Assembly Permit Application (Form 1)
- Hazardous Materials Use and Storage and Hazardous Processes: This is a permit for all buildings that store or use hazardous materials, conduct hazardous processes, or store products that pose an elevated fire or health danger, including automotive repair facilities. Permits and inspections are issued on an annual basis.
- Combustible Storage: This is a permit for all ground tank installation and removal including any type of tank storing any type of material, except heating fuel tanks. All tank removals require notification to the Fire Marshal's Office and a Demolition Permit from the Department of Planning & Developments Building Division is also required.
- Fire Works and Explosives: This permit is for all those facilities responsible for the manufacture, storage and use of all pyrotechnics. The Fire Marshal's Office is responsible for the regulation, inspection, and issuance of these permits in addition to the supervision of all pyrotechnic displays to audiences. A permit is required for all such displays, including those by a non-profit and for the general public.
- Tents: This permit is for any tent larger than 200 square feet in a commercial zone or 120 square feet in a residential zone. The Fire Marshal's Office is responsible for the regulation, inspection and insurance of all tent permits.
- System Installation: The Fire Marshal's Office is responsible for the plan review, installation inspection and witness testing of all Fire Suppression and Detection Systems. The Fire Marshal's Office follows the New York State Fire and Building Code and all reference standards such as the National Fire Protection Association Systems.
- Public Assembly: This is a permit for all buildings that are wholly or partially being used for public assembly. Any building or area that can hold more than 49 people based on the square footage requires a Public Assembly Permit. Permits and inspections are issued on an annual basis.
- Do I need a permit to install a wood burning stove or fireplace?

Yes, a Building Permit is required for wood burning stoves or fireplaces. The Building Permit Application is available online or can be obtained from the Department of Planning & Development's Building Division.
- Do I need to submit plans for a fire suppression and detection system?

Yes, it is required to submit plans for any new installation or any alteration of an existing fire suppression and detection system. The application, Installation/Construction Permit Application (Fire Prevention Form 2), is available online. It must be completed in full and notarized. There are associated fees related to the permit depending upon the system. The Fire Marshal's Office reviews all plans within ten days.
- Do I need a permit to install a Hood and Duct system?

Yes, a Fire Prevention Permit from the Fire Marshal's Office and a Building Permit from the Department of Planning and Development's Building Division are required to install a Hood a Duct System:

Yes, fire hydrants must be flow tested and maintained on an annual basis by a licensed and qualified contractor. A suggested list of Private Hydrant Inspection Contractors is available online.
- Are commercial properties required to test their fire and smoke detection and sprinkler systems?

Yes, New York State Fire Code requires that all systems be tested and maintained on an annual basis. All work must be performed by a New York State Alarm Installer. The forms are available online:
