Responsibilities of Code Enforcement
The Division of Code Enforcement is responsible for the investigation and enforcement of New York State Uniform Fire Prevention and Building Code and Town of Babylon Code violations which occur at residential and commercial properties. This division works closely with local police and government agencies to improve the quality of life of Town of Babylon constituents. They are NYS certified Code Enforcement Officials and have the authority to issue summonses when necessary.

- Do I need a rental permit to rent my home?

A rental permit is required any time a non-owner occupied home or a second unit in a legal two family dwelling is occupied by someone other than the owner(s) on the deed of the property. See Town of Babylon code 153.2A regarding permits required for rental units.
- Can I rent an apartment in my house?

Single family dwellings with a second unit must have a valid Accessory Apartment permit.
- Are basement apartments allowed in the Town of Babylon?

No, basement apartments are not permitted within the Town of Babylon.
- Are unregistered vehicles allowed on private property?

No, all vehicles on private property must be registered with valid & visible license plates and a valid vehicle registration. See Town of Babylon Code section 133-25.
- What is a commercial vehicle?

Any commercially registered vehicle, including but not limited to a bus, a minibus, a box truck, a tractor-trailer combination (or either component thereof), an ambulance, an articulated bus, an automobile transporter, a boat transporter, a hazard vehicle, a livery, an omnibus, a sani-van, a taxi, a tow truck, a truck, a vanpool vehicle, or any vehicle bearing commercial advertising or identification or any vehicle which is not designed for use as a passenger-only vehicle, which is not a limousine, taxi, livery or other for-hire vehicle.
- Are commercial vehicles allowed on my property?

Parking and/or storing of commercial vehicles on residential premises for a period of longer than one hour and exclusive of local delivery is not permitted.
Parking of commercial vehicles, buses and trailers exceeding 2 ½ tons (5,000 lbs.) on a roadway is prohibited.
- Am I allowed to rent rooms in my house?

No. Rooming houses are not permitted in the Town of Babylon without proper authorization.
- Are boats permitted on residential property?

Yes. Boats are permitted in the driveway, rear yard and side yard as long as it’s on a registered boat trailer or on blocks/boat stands. Also, boat storage cannot present a sight obstruction or sidewalk obstruction.
- Can I have chickens?

No person shall keep, maintain, house or possess any fowl on or in any building, yard or enclosure within the Town which shall be within 100 feet of the dwelling house or living quarters of any other person.
Maintaining chickens is a potential health hazard as their coups attract rodents.
- What is the Town Code for high grass?

According to Town Code: 133-25.1, residential property grass can be eight (8) inches high and grass on vacant lots are permitted to grow as high as two (2) feet. If a property is found to be in violation of this Town Code, a letter will be sent notifying the property owner to cut the grass. Property owners are given 10 days to comply or a summons will be issued.
- What is the Town Code for property fences?

According to Town Code: 213-75.14, when installing a personal property fence, the good side must face out and away from the house.
- How do I know if a fence is on my property or my neighbor's property?

It is the homeowners responsibility to check their property survey to determine where the fence is located.
- What hours of operation must landscapers keep when working on personal property?

According to Town Code: 144-7c, lawn service companies and landscapers are permitted to work Monday through Saturday from 8:00 am to 7:30 pm, and on Sunday from 11:00 am to 5:00 pm.
- Can landscapers or lawn service companies blow dirt and leaves onto the street?

According to Town Code: 144-7c, lawn service companies and landscapers are not permitted to blow dirt and leaves onto a public street.
- What is the Town's Code for barking dogs?

According to Town Code: 106-21, residents are allowed to house four (4) dogs in their home. According to Town Code: 106-6, no person who owns, possesses or harbors a dog shall permit or allow such a dog to bark, howl or whine in a loud or prolonged manner which shall unreasonably disturb any other person. All barking dog complaints should be submitted to the Town's Animal Shelter.
- What is the Town's Code on loud music and/or noise?

All noise complaints should be referred to the Suffolk County Police Department.
- Are unregistered vehicles allowed on personal property?

No. Town of Babylon Town Code 133-25 specifies that no unregistered vehicles are allowed to park on personal property or in the street.
- Can boats be parked on personal property?

Yes. Boats hitched to a registered trailer or placed on cinder blocks may be parked on personal driveways or the back of a dwelling. Boats cannot be parked in the front yard or cause a sight obstruction for adjacent homeowners when backing out of their driveways.
- Are trucks with commercial plates allowed on personal property?

No. Town of Babylon Traffic Code (Section 5-1) specifies that no commercial vehicles are allowed to park on personal property or in the street.
- Can homeowners and tenants park vehicles on the street?

Yes. The street is public property and does allow public parking unless a sign is posted designating no parking.
- Who do I call about a car obstructing a sidewalk?

Concerns about vehicles obstructing the public right-of-way, should be directed to Citizen Services at (631) 957-TOWN (8696). A Public Safety officer will be sent to the location and, if found in violation of Town Code, will tow the vehicle and issue a summons to the vehicle owner.
- Can I park a vehicle on the street for the purposes of selling it if it does not have license plates or vehicle registration information?

No, it is against Town Code to park any vehicle on the street that is not registered and does not have license plates. If a vehicle is parked on the street and is in violation of Town Code, it will be towed and the vehicle owner will be issued a summons.
