1. What does the Town's Fire Marshal's Office do?

The Town of Babylon's Fire Marshal's Office protects life and property from fire and explosion and manmade and natural hazards through the efforts of investigation of fire and explosion incidents, quality fire protection inspection services, enforcement of the State Fire Prevention laws, data collection and analysis, and public safety education. The Fire Marshal's Office works with 11 fire departments and one ambulance corp, encompassing the 58 square miles of the Town of Babylon. The Fire Marshal's Office is responsible for:

• The enforcement of the NYS Fire and Building Codes, the Town Code, and the NFPA Code, as well as issuing violation and criminal appearance tickets for noncompliance with those codes
• Restricting occupancy of a building or use of equipment due to violation of the law and adverse health and safety conditions
• Investigation involving hazardous materials, homeland security incidents, inspections, plan reviews and education

2. Where is the Fire Marshal's Office located and what are their hours?

The Fire Marshal's Office is located at 281 Phelps Lane, North Babylon, NY 11703 at the Town Hall Annex. The office hours are Monday through Friday, 8:00 am to 4:30 pm. Fire Marshals are on call for response 24 hours a day, 7 days a week.

4. Who do I call in an emergency?

If you are experiencing an actual emergency, whether fire, fire alarm, carbon monoxide or other hazardous condition related, immediately contact Suffolk County Police by dialing 9-1-1. For Fire and Rescue Dispatch in the Town of Babylon, dial  (631) 226-1212. In East Farmingdale, call (631) 249-0474 for fire and rescue dispatch. 

5. Do I need carbon monoxide detectors in my home or business?

Yes, several State, County and local laws do require carbon monoxide detectors in homes and businesses, including Amanda's Law, which specifically requires that carbon monoxide detectors be installed in homes. This law can be found online on the NY State Department website.

6. Do I need smoke detectors in my home or business?

Yes, all residential properties require smoke detectors in each sleeping area as well as adjacent to sleeping areas. Depending on when a house was built, some smoke detectors will either need to be battery powered or required to be hard-wired and interconnected. The Fire Marshal's Office can provide more specific information.

7. Is it legal to have a fire pit in a backyard?

No, it is illegal to have an open fire or flame of any type on a property. The only exception is an outdoor grill, a similar cooking appliance or an appliance that cooks over a wood flame. You can only use the amount of wood necessary for cooking and the fire must be immediately extinguished upon completion. All wood must be seasoned firewood only. No fresh cut branches or debris. Residents are urged to never leave an open flame or outdoor cooking appliance unattended.

8. Can I barbecue if I live in an apartment?

You can barbecue if you live on the 1st floor of an apartment complex, but the barbecue grill/appliance must be used at least 15 feet away from the apartment building. You may not barbecue on an apartment patio or deck if you live on the 2nd floor or higher.

9. Do fire extinguisher's need to be inspected?

Yes, fire extinguishers must be inspected on an annual basis by a licensed contractor (not by the Fire Marshal's Office). The contractor must be licensed by Suffolk County to perform this work.

10. How do I dispose of an old fire extinguisher?

Old fire extinguisher's cannot be thrown out with regular trash items or recycled items but can be brought to the Fire Marshal's Office for disposal. You may also contact the Fire Marshal's office at (631) 957-2153 to pick up any old fire extinguishers.

11. Are there Emergency Shelters available to residents in an event of a storm or natural disaster?

Yes, there are emergency shelters throughout the Town but they are not always open during every storm. If there is a severe storm in the area, residents are urged to listen to the local radio stations for shelter location information.

The Department of Emergency Preparedness has more information about what to do during natural disasters or storms, including where to locate designated emergency shelters.

12. Can fuel be delivered to a boat, house or dock?

No, all fueling must be done at a marine gas and fuel station and cannot be done on private property.

14. I had a Fire at my property, how do I obtain a copy of the Fire Report?

If the Fire Marshal’s Office responded to an incident, you can get a copy of the Fire Report by first completing a Freedom of Information Law form at the Town Clerk’s Office at Babylon Town Hall. . Additionally, you can get a copy of a Fire Report from the Local Fire Department that responded.
